An easement vacation request is causing a riff between homeowners in the tight-knit subdivision of Mountain Meadows west of Cheyenne.

To address current encroachment issues, a group of property owners is asking the Laramie County Board of Commissioners to approve partial easement vacations for 9 lots within the 92 lot subdivision located near Curt Gowdy State Park.

"It's a gray area," said Commissioner Ron Kailey. "We have the right to vacate those easements to help out a homeowner who's structure ended up in that easement, but at the same time, those easements are kind of shared through everybody's."

After nearly two-and-a-half hours of public comment Tuesday, commissioners voted 4 to 1 to postpone voting on the issue until their May 3 meeting.

"I just don't think we have all the ducks in a row to make a motion then have it end up in some kind of conflict down the road," said Kailey, who made the postponement motion. "I wanted to make sure everything was legal upfront and whatever motion made is backed by the county attorney and the clerk's office."

Commissioner Amber Ash strongly encouraged property owners to "work it out for themselves" when their board meets in two weeks.

"I don't know how you can get ninety property owners together and have all of them agree on anything," said Kailey. "So you're never going to hope for 100 percent, but maybe you can get the HOA board to come together and work with the people that, whether it was their fault or some other fault, ended up building in the easements and that's who I feel for."

The Mountain Meadows Homeowners Association will hold its annual meeting in the Curt Gowdy State Park Visitor Center on April 20 at 6:00 p.m.
