The Wyoming Board of Pharmacy and City Drug in Cheyenne have reached an agreement for the drug store to remain open, with conditions.

Among the conditions is that owner Kelsey James must sell the store within six months. James can ask the board for more time with good cause. James' pharmacy license has been revoked for three years. She can ask for reinstatement of her license after that time.

City Drug must also pay over $48,000 in fines and penalties. A three-year license suspension for City Drug has been stayed--meaning it will not take effect--as long as seven conditions are met. Those conditions include that the pharmacy not compound any drugs during the three year period and that a new head pharmacist be appointed to replace James

Background Of Disciplinary Action, Settlement

Pharmacy Board officials suspended the drug store's pharmacy license a few weeks ago for allegedly violating a board order issued in March.  According to the minutes of the March pharmacy board meeting, that order was issued because City Drug allegedly compounded the drug  semaglutide earlier this year without the required sterile equipment.

The settlement agreement ends a process which included a contentious September 18 public meeting in which City Drug supporters were angered by the board not allowing them to speak. One woman was forcibly removed by Wyoming Highway Patrol troopers from that meeting.

A followup special meeting on Wednesday to consider the settlement agreement was conducted via teleconference. During that meeting, state Rep. Jeanette Ward [R-Natrona County] asked to address the board and was not allowed to do so. Ward said at the time she didn't understand why no public comments were allowed at a public meeting.

Board President Brenda Upton responded that while the board was legally obligated to allow the public to observe the meeting, there was no obligation to take public comments.
