A 32-year-old Cheyenne man is being held on a $10,000 cash bond after being charged with felony stalking and numerous protection order violations.

According to a booking sheet, on Oct. 29, Zacharaiah Thomas Nicely was transported to the Laramie County Detention Center on multiple Circuit Court warrants.

5 Warrants

On Oct. 31, Nicely was seen in Laramie County Circuit Court in front of Judge Sean C. Chambers on five dockets.

Three alleging that on Aug. 3, on Aug. 10, and on Sept. 5, he willfully violated an order of protection, a misdemeanor punishable by up to six months in jail, up to a $750 fine, or both.

One alleging that between Aug. 9-17, he committed felony stalking by harassing K.H. in violation of a protection order, a crime punishable by up to 10 years in prison, up to a $10,000 fine, or both, and on Aug. 17 committed a protection order violation, a misdemeanor punishable by up to six months in jail, up to a $750 fine, or both.

And one for failing to appear for an arraignment on Sept. 5 on a related charge of violation of a protection order.

'I Did Turn Myself In'

"I have been aware of the warrants," Morehead told Chambers. "I had no way to get here. I've been working out of Grand Junction. I talked to the police up there (and) I did turn myself in in Grand Junction when they did transfer over."

"I have been trying to work with the courts, I was just in a tough situation, and I just ask for forgiveness for that so I can have a job," Morehead added, saying he had a job lined up in Cheyenne and wouldn't leave town.

"I'm going to set your case for a preliminary hearing and arraignment on Nov. 10 at 9:30 a.m.," said Chambers, who then asked for the state's bond recommendation.

"While I appreciate that Mr. Nicely does have a job and was aware of these warrants to turn himself in, frankly, the number of violations in such a short time alone give the state significant concern for not only the safety of the victim, but also Mr. Nicely's ability and willingness to comply on court orders," the state said. "He was previously given a signature bond and then obtained multiple new identical charges as well as more serious charges with the felony stalking."

"I see failure to appear here (and) in Nebraska, and I know through contact with the victim with our office there are some concerns down in Colorado as well," the state added. "All of that leads the state to believe that a cash bond is more than appropriate and would request $10,000 cash in the felony and $5,000 cash on the misdemeanors."

Bond Set at $10K Cash

"I'm going to set a $10,000 cash only bond across all dockets," said Chambers, who then appointed Morehead a public defender.
