A 49-year-old Cheyenne man is facing charges, including a felony charge, after reportedly getting into a physical altercation with law enforcement and deploying a chemical agent against them.

According to booking sheets, it all started around 9:06 p.m. on Tuesday, March 4, after two officers from the Cheyenne Police Department and a deputy from the Laramie County Sheriff's Office were called to the 1600 block of Converse Avenue for a traffic complaint or possible REDDI report.

Police say the suspect vehicle was running but stopped over the curb and partially on the grass in front of the apartments at 1621 and 1623 Converse Ave., and one of the residents, 62-year-old Jane Marie Miller, was in the driver's seat.

Police say Miller's speech was slurred, repetitive, inconsistent, and illogical, and she smelled of alcohol. They say she also demonstrated severely unsteady balance when they asked her to get out of the vehicle.

Miller reportedly refused to conduct standardized field sobriety tests and was arrested for DUI - first offense, a misdemeanor.

DUI Arrest Leads to Physical Altercation, Felony Arrest

Police say Miller's domestic partner, Brian Scott Mattert, then came out of the apartment, and a physical altercation ensued, during which he deployed a chemical agent against the officers and deputy.

Police say the chemical agent got into one of the officers' faces, and the other officer and deputy received secondhand exposure.

Mattert was then reportedly tased, which caused him to fall and hit his head on the sidewalk, handcuffed on the ground, taken to Cheyenne Regional Medical Center for jail clearance, and booked into the Laramie County Detention Center.

Mattert was subsequently charged with aggravated assault on a peace officer, a felony punishable by up to 10 years in prison, interference, and simple assault.

Bond Set at $2,500 Cash

Mattert made his initial appearance in Laramie County Circuit Court on Thursday, March 6, during which his bond was set at $2,500 cash, and his preliminary hearing was scheduled for Thursday, March 13, at 3 p.m.
