A man who was busted for drugs after Cheyenne Police found him asleep in his van in a gas station parking lot has been sentenced to federal prison.

United States District Court Judge Kelly H. Rankin on Tuesday, Oct. 15 sentenced 33-year-old transient Brady Arthur Mitchell to 21 months for being a felon and unlawful user of a controlled substance in possession of a firearm.

According to arrest records, police were called to the Sinclair at 820 W. Lincolnway at 7:19 p.m. on April 13, 2024, for a welfare check.

Police say Mitchell was sitting in a van with a small hatchet next to him, and when they contacted him, he started digging around in the van.

When police asked Mitchell to step out of the van and pat him down for weapons, they reportedly found a glass pipe and two metal straws with burnt residue inside of them.

Police say after a search, Mitchell was found to have 12 ounces of marijuana, 3.75 grams of fentanyl, 3.31 grams of Xanax, and a small clear plastic baggie containing a white crystalline substance suspected to be methamphetamine.

Police say Mitchell also had a loaded .22 caliber revolver in his waistband.

Mitchell was subsequently arrested and indicted. He pled guilty on July 11.

In addition to the 21-month sentence, Rankin also gave Mitchell three years of supervised release.
